Advertising your Vehicle

By submitting an advertisement to the Visitcars web site, you are deemed to have accepted the terms and conditions laid out here. These terms and conditions and the contract of which they form part shall be governed by English law. All references to "the customer" refer to the user applying to place an advertisement for a vehicle on the Visitcars web site. All references to "the web site" refers to the internet site. All references to "us" refers to Visitcars and Whichdeal Ltd.

This service offers the facility to place an advertisement for a used vehicle on the web site. Advertisements placed on the Visitcars group web site will also appear on Visitcars group's other partner sites if required or requested.

Advertisers are offered the option of placing an advertisement for a period of 31 days from the date of first publication on the web site.

Processing your advert

Only one vehicle may be featured in each advertisement.

The advert copy you supply must be legal, decent, honest and truthful and must comply with the British code of Advertising. Visitcars group is not able to verify the truthfulness of any statements (including the authenticity of photographs) made by a customer in the advertisement copy.
Accordingly, the customer shall be responsible for any losses, expenses or other costs incurred by Visitcars group caused by an untrue statement or inaccurate photograph supplied by the customer.
In order to meet the technical and production requirements of the web site, Visitcars group reserves the right to edit, amend or alter the copy or photograph supplied by the customer. The copyright in all adverts (including text and photographs) shall be owned by us and you hereby assign all such copyright to us.

Other advertisements

Visitcars group is only able to display one advertisement for each vehicle at any one time on the web site. If the customer orders a subsequent advertisement for a vehicle which is already advertised on the web site, then the subsequent advertisement will replace the previous advertisement for that vehicle.

The time period for the first advertisement will automatically expire when it is replaced by the subsequent advertisement on the web site. Visitcars group will not be liable to reimburse the customer for any period in which the first advertisement has been paid for but has not been displayed.

Payment for on-line advertisements must be made through our web site.

To process card payments we will refer you to a dedicated commerce provider, who will take payment via a secure sever (SSL) connection to ensure the safety of your payment on-line. Payment can be made using Visa, MasterCard or Maestro. To ensure further security when placing an advert you will be prompted to enter the CVC2 security code from your card. This is the last three digits on the signature strip on the back of your card. Providing this information confirms that the advert placer has seen the card.

Even greater security can be gained by using Verified by Visa or MasterCard Secure Code. Once registered, you will be prompted to enter your password at the checkout to ensuring that no one else can use your card.

No other payment method can be accepted.
While every effort is made to ensure the safety of your credit card transaction, Visitcars group can not accept liability for any loss or damage incurred as a result of using the secure payment facility.

In order to register for full access to the Visitcars group channel we will require you to supply your name, e-mail address, postal address and post code.

On-line advertisements placed on the channel will, in addition require payment details, a land-line telephone number, with a mobile number and e-mail address supplied as an option. Credit card information is collected over a secure connection.

Use of Information
Telephone numbers supplied as part of a vehicle advertisement will be published within the relevant advertisement only for the duration of the booking.

Credit card information is used solely for the purpose of payment processing. Visitcars group retains no record of credit card details.

Security In accordance with the requirements of the 1998 Data Protection Act - we have taken measures to ensure that information supplied to us is held securely. As a consequence - we may occasionally request proof of identity before allowing access to your personal information.

You have the right to access, request and amend all personal information supplied to Visitcars group.

How to cancel an advert

A full refund can only be obtained if the advert has not gone live on the Visitcars group website. Adverts are processed 7 days a week within a maximum of 24 hours including weekends and bank holidays. However, the publication of an advert can be cancelled to avoid unwanted response (subject to publication deadline). Advertisements can be cancelled by sending an e-mail - quoting the advertisement reference number - to or by contacting customer services on 08717 502 495

How and when your order will be confirmed

As soon as an advertisement has been accepted, a confirmation email will be sent to the advertiser explaining that the advertisement has gone live on the site.

How you can change and delete your advert once live

Once your advert has been accepted onto the website, a confirmation email will be sent to you with details on how to amend your advert once it's live on the site. If you need to add or change your photo, you can now do so via the on-line edit functionality.

Visitcars group will require to carry out routine maintenance and service of 'its' servers and equipment. While Visitcars group seeks to keep disruption to a minimum, it does not guarantee that the advertisement will be continuously available on-line for the duration of the advert.

Visitcars group's liability for breach of contract or negligence shall not exceed an amount equal to the price of the advert or series of adverts involved, provided that nothing in this clause shall limit Visitcars group's liability for death or personal injury caused by our negligence or that of our service or agents.

English law shall govern the terms and conditions of this contract of which they form a part.

Data Protection

By accepting the Terms you are consenting to the collection, use and disclosure of data, including data regarding not only the applicant but also people with whom the applicant is financially associated, on the following terms.

If you are applying for finance on behalf of another person you warrant that you have obtained their clear and informed consent to the matters described below. If you are applying for finance on your own behalf you give your consent to the matters described below.

You agree and warrant that any person on whose behalf you are applying for finance has agreed that Visitcars may search your record and that of any person on whose behalf you are applying for finance, including any person with whom the applicant is financially associated, at credit reference agencies. They will add to the record of the person searched, details of the search and the application, and this will be seen by other organisations that make searches.

Visitcars may use credit scoring or other automated decision making systems when assessing the application.

It is important that the information given to us is accurate. You warrant the accuracy of all information provided as part of or in connection with a proposal submitted using this Web site. We will check your details and/or the details of any person on whose behalf you are submitting a proposal and those of any director, partner or guarantor, with fraud prevention agencies and, if you give us false or inaccurate information and we suspect fraud, we will record this.

Your record and/or that of any person on whose behalf you are submitting a proposal will be shared with other organisations and used by us and them to:

  • help make decisions about credit and credit-related services for you and/or the applicant and possibly directors, partners and guarantors and members of their households.
  • trace debtors, recover debt, prevent money laundering, fraud and manage your or the applicant's accounts.
  • check your identity to prevent money laundering, unless you furnish us with other satisfactory proof of identity.

We and the credit reference agencies and fraud prevention agencies may also use your record and those of any director, partner or guarantor for statistical analysis about credit and about insurance and fraud.

Fraud prevention agency records will also be shared with other organisations to help make decisions on motor household, credit, life and other insurance proposals and insurance claims, for you and/or the applicant and members of your or their household.

Visitcars may hold and process, by computer or otherwise, any information about you or any person on whose behalf you are submitting an application obtained as a consequence of your use of this Web site and/or any resulting or ancillary agreement or your or their conduct of any agreement between you or them and Visitcars ('Personal Data') for the purposes of:

  • a) Crime prevention, tracing debtors and recovering monies owed
  • b) Statistical analysis
  • c) Considering applications for finance by you or them or any member of your or their household and implementing or performing any such ancillary or resulting agreement mentioned above
  • d) Visitcars's funding or securitisation arrangements
  • e) Customer satisfaction surveys or offers of both current and future products or services whether by Visitcars or any third party
  • f) Insurance claims or placing of insurance
  • g) Operating the Web site and maintaining records in relation to the Web site; analysing the use of the Web site and visiting patterns; matching user information with third party data in order to produce aggregated statistics and/or personalising the Web site

And we shall be entitled to disclose Personal Data to the following persons or organisations:-

  • a) To credit reference or fraud prevention agencies

This agreement is governed by the laws of England. You hereby consent to the exclusive jurisdiction of the English courts in all disputes arising out of or relating to the use of this Web site. You agree that no joint venture, partnership, employment, or similar relationship exists between you and Visitcars as a result of this agreement or use of this web site.

Visitcars's performance of this agreement is subject to existing laws and legal process, and nothing contained in these Terms is in derogation of Visitcars's right to comply with law enforcement requests or requirements relating to your use of this Web site or information provided to or gathered by Visitcars with respect to such use.

If any part of these Terms is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the Terms shall continue in effect.

The agreement constituted by your acceptance of the Terms constitutes the entire agreement between the user and Visitcars with respect to this Web site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between the user and Private and Commercial Finance and with respect to this Web site. A printed version of such agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

You will be responsible for all charges, fees, duties, taxes and assessments arising out of your use of this Web site.

Agreement between the user and Visitcars

This document governs the relationship between you and Visitcars when you use any of our mobile/SMS/MMS Site services.

We provide our mobile/SMS/MMS Site services to you subject to the following terms and conditions. You must read these terms and conditions before using the mobile/SMS/MMS Site services. By using the mobile/SMS/MMS Site services you agree to be bound by these terms and conditions. In addition, when using particular services such as playing games or entering competitions by means of mobile/SMS/MMS, you shall be subject to any further guidelines and rules applicable to such service which may be posted by us from time to time. All such guidelines and rules are hereby incorporated by reference into these terms. In the case of any inconsistency between any such guideline or rule and these terms, the guideline or rule shall prevail. If you do not wish to be bound by these terms and conditions, you may not use the mobile/SMS/MMS Site services.

"Contract" means this agreement; "Distributor" means any Network Operator, aggregator or other third party that may provide the Service to you or bill you for the Service on our behalf;

"Information" means all material delivered by us through our mobile and/or SMS and/or MMS Site services;

"Network Operator" means a mobile telephone network operator;

"Service(s)" means any or all of the mobile/SMS/MMS Site services provided by us (whether alone or in conjunction with your Network Operator);

"we", "us", "our" means VISITCARS Networks Waterloo House, Fleets Corner, Nuffield Industrial Estate, Poole, Dorset, BH17 0HL, VAT no: GB851687202;

"you", "your", "yourself" means you, the service end user; and

"MMS Site" means the MMS site accessed via a mobile device at

2.1 We (or the relevant Distributor) will always notify you of the likely charge for using a Service. For example, when entering a competition, purchasing a game or voting via mobile/SMS or the WAP Site, the programme on which the competition/vote was featured or the relevant section of the WAP Site will inform you of the price of registering your vote/entry or the cost of purchasing the game. However, your Network Operator may also charge an additional standard messaging fee for any SMS sent / received by you or a browsing and/or downloading fee for your use of the WAP site. Please consult your Network Operator for further details of these standard costs.

2.2 When you download Information for a fee from the WAP Site, the Distributor that is responsible for billing you for the Service may charge you a minimum transaction fee that may exceed the cost of the Information that you are downloading. The excess charge will be held by the Distributor as credit that you can redeem against future downloads from the WAP Site. Such credit is only available for your use for one hundred and eighty (180) days, after which time it will be removed from the Distributor's database.

2.3 Charges for the relevant Service will be deducted from your available credit time if you are a pre-pay customer or will appear on your monthly statement if you are a pay monthly customer. You must always obtain the permission of the person paying the bill for the relevant mobile device before using any Service.

3.1 Part of the Service(s) provided by us to you may include reverse billed premium rate SMS services. These services operate by delivering content to mobile devices for a charge. Users subscribe to a Service and are charged at the standard messaging cost of the relevant Network Operator for such message. Users will then receive the requested content, and are charged by us for the delivery of such content at a premium rate. The primary cost of the Service to users is incurred not when users send the message to subscribe to the Service, but when we send the user the requested content in return. Consequently, these services are known as reverse billed premium rate services. Such premium rate services are charged per message and not per minute.

3.2 Where we use reverse billed premium rate services we will notify you of the likely charge for receiving such content/message from us. The charge will be between a specified price range depending on your Network Operator and the Network Operator may also charge an additional standard messaging cost. Please consult your Network Operator for further details of its standard messaging costs.

3.3 When requesting a Service via SMS message, the return SMS message will usually give you details of how to withdraw from that particular Service. The withdrawal message will be charged at your Network Operator's standard messaging rates. For further information on any of our Services, including reverse billed premium rate services, email us at

4.1 We, as a service provider, contract with Distributors for facilities to enable the provision and billing of the Service(s) to you.

4.2 As such, components of the Service(s) are supplied to us and/or to you directly by third parties and we can make no promises, express or implied as to such elements of the Service(s), including without limitation, its accuracy, relevance or quality. The Service(s) are subject to the limitations of the enabling technology on which they rely and may be adversely affected by network performance and other technological or operational factors beyond our control such as congestion, network coverage, dropped connections and the performance of your mobile device.

4.2 In relation to those components of the Service(s) under our control, we will always seek to uphold the rights that you are entitled to at law including your right to receive a satisfactory service from us and we will seek to correct any errors or omissions that are brought to our attention. Other than in respect of these rights, the Service(s) are provided on an "as is" or "as available" basis and we make no promises or representations, whether express or implied, in relation to the Service(s), including but not limited to implied promises or conditions of completeness and accuracy.

4.3 Where the Service(s) are provided to you directly by a Distributor, the take up and use of these Service(s) by you may be subject to the Distributors own terms and conditions. However, you will remain bound by these terms and conditions to us where applicable and in the event of a conflict between the Network Operator's terms and conditions and these terms and conditions, these terms and conditions shall prevail.

4.4 You acknowledge that subject to 4.2 above: (a) it is technically impossible to provide the Services free of faults and that we do not undertake to do so; (b) faults may lead to temporary unavailability of one (1) or more of the Services; (c) the results that may be obtained from the use of the Service(s) may include inaccuracies or typographical errors; and (d) the operation of the Services may be adversely affected by conditions and performances outside our control, including without limitation, transmission and telecommunications links between us and you, between different parts of our company, and between us and other systems and networks.

4.5 In addition to 4.4 above, we will not be liable to you for failures, defects or delays in the delivery of the Service(s) which are caused by any of the following: (a) you have provided an incorrect phone number, incorrect spelling or other incorrect information in connection with the Service(s); (b) your mobile device does not support the Service(s); (c) your message mailbox is full and has no memory to receive a download of the Service(s); (d) your mobile device is out of range or cannot be contacted for any other reason; (e) you accidentally erase a Service provided to you; or (f) your failure to comply with the instructions for use of the Service(s) as explained by us and/or your Distributor.

5.1 We do not seek to limit or exclude our liability for death or personal injury arising from our negligence or that of our employees or agents nor for fraud.

5.2 Other than as set out in 5.1, we shall not be liable in contract, tort, negligence, statutory duty or otherwise, for any loss or damage whatsoever arising from or in any way connected with this Contract or the use or performance of the Service(s) in respect of any:

(a) loss of business;

(b) loss of profits, business interruption, loss of business information; or

(c) any other pecuniary loss;

nor shall we be liable to you for any damage to your mobile or other device or loss of data that results from your use of the Service(s) and we cannot guarantee that any files that you download are free from viruses, contamination or destructive features.

5.3 Subject always to 5.1 and 5.2 above, our total liability arising out of or in connection with the Service(s) and/or this Contract shall be limited in aggregate to 150% of the price you have paid for the relevant Service(s) from us.

6.1 We provide the Service(s) to you solely for your personal, non-commercial purposes. The Service(s) may not be used for any other purpose including without limitation, publication, reproduction or transmission nor provided to any other person and you are not permitted to amend any of the contents of the Service(s) unless expressly permitted by us.

6.2 If you send any material to us, you thereby grant us an irrevocable, unconditional, worldwide royalty free licence to use such material or any part of it in perpetuity in any and all media and in any manner we may determine in our sole discretion. Furthermore you thereby waive all so-called moral rights or other similar rights in such material.

6.3 All rights not expressly granted are reserved to us and our licensors as appropriate.

7.1 We provide the Service(s) to you solely for your personal, private use. You undertake not to use the Service(s):

(a) for any unlawful purpose;

(b) in any way so that the Service(s) are interrupted, damaged, rendered less efficient or the functionality of the Service(s) are in any way impaired;

(c) in any way that may damage or disrupt your or another user's mobile device;

(d) for the transmission of any computer viruses or any harmful or deleterious files or programs;

(e) to transmit, post or otherwise make available any material which is defamatory, offensive, racist, vulgar, libellous or of an obscene or menacing character, or in such a way as to cause annoyance, inconvenience or needless anxiety;

(f) as a means to threaten, stalk, harass, abuse, or otherwise insult other users or to collect or store personal data about other users;

(g) in a manner which constitutes a violation or infringement of any person, firm or company's rights (including, but not limited to, rights of copyright or confidentiality);

(h) in a manner that may cause harm to yourself or your property or another person or their property;

(i) to transmit any material for the purposes of publicity, promotion and/or advertising without our prior written consent unless such transmission has been specifically requested by another user of a Service;

(j) to create a false identity for the purpose of misleading others as to the identity of the sender or the origin of a message, including, but not limited to impersonating an VISITCARS employee, manager, host or another user; or

(k) to transmit, post or otherwise make available any solicited or unauthorised advertising, promotional materials, "junkmail", "spam", "chain letters", "pyramid schemes" or any duplicative or unsolicited messages.

7.2 You agree to comply with any age restrictions notified to you in respect of any given Service.

We are concerned about the safety and well being of all our users, but children in particular. Parents or guardians who allow their children to use the Services should take care to supervise and assist their children. We remind you that the Services are designed to appeal to a wide audience. As the legal guardians, we remind parents and guardians that it is their responsibility to supervise children and to determine whether particular Services are suitable for your child. If you have any concerns about any Service, then please do not hesitate to contact us at the address set out above.

9.1 You undertake in the event that you have any right, claim or action against any other user or a Distributor arising out of the provision and/or use of the Service(s), you shall pursue such right, claim or action independently of and without recourse to us.

9.2 You will fully compensate and defend us against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of this Contract or any use of the Service(s) or the Information by you.

9.3 You acknowledge that we have limited control over the nature and content of Information transmitted or received by you or others who use the Service(s) and that we do not examine in any way the use to which you put the Service(s). The way in which you use the Service(s) is at your risk and you agree to fully compensate us against any claims or legal proceedings arising in connection with your use of the Service(s) that are brought or threatened against us by any other person.

You acknowledge that all copyright, trade marks and all other intellectual property rights in the Service(s) and Information shall remain vested in us or our licensors.

11.1 We shall have the right to immediately suspend or withdraw a Service if you commit or we have reason to suspect that you have committed a breach of these terms and conditions. or where required by law or regulatory authority or a Distributor.

11.2 Where applicable, you may withdraw from a Service at any time. If you subscribe to a Service via our website(s), you can click on the "Update Profile" link when logged in on the website(s) and amend your profile accordingly. If you request a Service by sending us an SMS message, the message you receive confirming your request will give you details of how to withdraw from that Service.

When entering a specific competition by mobile/SMS or requesting/purchasing an VISITCARS branded game we will alert you to any particular rules and/or restrictions that may apply. Please ensure that you read our general competition rules which apply to all of our competitions in the absence of any specific rules to a competition. These can be found at the bottom of the competition pages and in our terms and privacy section of the website.

14.1 We reserve the right to change the terms and conditions of this Contract from time to time by placing a note of such change on our website. We recommend that you review these terms each time that you request a new Service so that you are familiar with any changes that may apply to it.

14.2 We also reserve the right to change and update the Service(s) from time to time although your attention is drawn to your right of termination at any time.


Each provision of this Contract excluding or limiting liability shall be construed separately, applying and surviving even if for any reason one or other of those provisions is held to be inapplicable or unenforceable in any circumstances and shall remain in force notwithstanding the termination of this Contract.

No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.

This Contract shall be governed by the laws of England and Wales (unless you are domiciled in Scotland in which case you may choose the laws of Scotland) and by the exclusive jurisdiction of the English courts (unless you are domiciled in Scotland or Northern Ireland in which case you may choose the courts of your domiciliary).

Visitcars Car Owner Review Competition

Terms & Conditions

Please read these competition rules carefully. If you enter this competition, we will assume that you have read these rules and that you agree to them. 1. This competition is not open to employees (or members of their immediate families) of Visitcars, or any subsidiary of Whichdeal Ltd. 2. No purchase necessary to enter. 3. One person can enter as many times as they wish. Each individual car owner review created will count as an entry to the competition. 4. The prize is £250 cash and is not transferable to any other prize. 5. If you want to enter a competition you may enter by completing a car owner review on and leaving your email. This email will be used to contact you should you win the £250 prize. 6. Submitting a car owner review is proof that we have received your entry. No responsibility can be accepted for entries that are lost or delayed, or which are not received for any reason. 7. The winner will be the entrant who is picked at random from the computer having completed a car owner review on by the specified closing date. 8. The closing date is the 31st December 2011, and Visitcars reserves the right to amend the competition end date at any time. 9. If you win the competition, we will notify you by e-mail. The judges’ decision will be final, and no correspondence will be entered into. 10. You can find out who has won a particular competition by sending a stamped addressed envelope, marked with the name of the competition to Visitcars, Marketing Team, Waterloo Road, Fleets Corner, Nuffield Road, Poole, Dorset, BH17 0HL after the closing date. 11. By entering the competition the winner agrees to participate in such promotional activity and material as Visitcars may require. 12. The panel of judges will be comprised of members of the marketing team of a relevant department of Visitcars. 13. The prize will not be transferable to another person. 14. This competition is being run by Pan Visitcars of Waterloo Road, Fleets Corner, Nuffield Road, Poole, Dorset, BH17 0HL ("Visitcars"). 15. Please read our Privacy Policy which tells you how we use any personal information we may collect about you by entering a competition. 16. Visitcars reserves the right to amend these rules at any time. Visitcars may also create rules which will apply to a specific competition only. If we do this we will publish the amended competition rules and/or specific competition rules on the relevant competition page. 17. Visitcars will endeavour to send prizes within a month of the competition end date but cannot guarantee this delivery time.
