Ethanol Backers Sue to Block California's Low Carbon Fuels Standard



A pair of leading ethanol fuel advocacy groups have challenged the constitutionality of California's new low-carbon fuel standard in federal court, saying it discriminates against out-of-state goods by effectively preventing the state's drivers from using corn ethanol from other states.


The rule, if adopted, may put a crimp on the expansion of U.S. ethanol use because California, which is the most populace U.S. state and accounts for more than one out of every eight new U.S. vehicles, has often taken the lead in domestic clean-air regulations.


The California Low Carbon Fuel Standard (LCFS) directs fuel producers to cut the carbon intensity of their products by 10 percent by 2020. It was tentatively approved by the California Air Resources Board earlier this year.


The ethanol groups contend it contradicts the 2007 Energy Independence Security Act and is scientifically flawed, The Renewable Fuels Association and Growth Energy filed their suit Dec. 24 in the U.S. District Court in Fresno - the heartland of California's agricultural industry.
